Asked about France Inter, the lawyer confirms that a request for suspension of sentence is about to be filed on Tuesday, as his colleague, Me Sylvain Cormier, had indicated the day before.
“When your condition is incompatible with detention, you have the possibility of requesting that your sentence be suspended”detailed Me Spinosi, specifying that it was not a question of a “favor” but of one “measure prescribed by the code” penal. It is the sentencing judge who is responsible for accepting or rejecting this request. “It is a question of taking into consideration the medical condition” of the Corsican independence activist, insists the lawyer.
“Hope exists but it is tenuous”
Treated in Marseille, Yvan Colonna will not be moved for the moment. “The challenge of his return to Corsica will exist if he recovers, for the moment he is where he is treated best”, specifies Me Spinosi. The Corsican independence activist was sentenced to life imprisonment for his participation in the assassination of the prefect Erignac, in 1998, in Ajaccio. About a possible future revival, his lawyer claims that if “hope exists”he stays “tenuous”.

And to specify that if such a suspension were pronounced, it would only be provisional: “If there is an improvement in his condition, the sentencing judge will have to re-examine the possibility of a possible reincarceration”. Me Spinosi also confirmed future “actions brought against the State” from Yvan Colonna’s family: “the time today is not for this type of approach, […] but it is certain that there will be questioning of a fault or a failure of the administration “.
