Victims of domestic violence cannot always flee their assailant by leaving the home. A decree published on June 6 brings them significant help.
Women victims of domestic violence often find it difficult to leave their homes to flee their attacker. If measures have been taken to remove violent spouses from their homes, the fact that the victims cannot leave remains a problem. A decree published in Official newspaper June 6, 2020 provides help with this problem. It makes it possible to unblock employee savings in advance.
Already possible in the event of a marriage, a PACS, the birth of a third child or even a divorce or separation, access to employee savings will now be possible in the event of domestic violence . The employee must have obtained a protection order from a judge, that is to say that her spouse will be prohibited from entering into contact with her and those around her, explains AFP. In addition, she will be able to benefit from this release if a judicial investigation has been opened for the acts of violence, if there is a referral to the court, if her violent spouse is under investigation, if he has been convicted including non-definitively, if there is an alternative to prosecution, or if there is a criminal composition.
This measure was announced after the Grenelle Convention against domestic violence, in November 2019. The State Secretariat for Gender Equality explained that it was "to be able to have funds within a short time to cope with the material changes imposed by their situation, for example if they are forced to move". This allows women to be independent so that they can flee the home. "It's always good to take for those who can benefit from it", says Françoise Brié, of the National Federation of Women Solidarity, to AFP.
Unfortunately, not all victims will have access to the release of employee savings. In fact, only 51% of them have a job, and they do not all benefit from this system. Gold, "precariousness is an aggravating factor to get out of violence", underlines Françoise Brié.
