Cap Ferret: the five-star hotel project confirmed before the Council of State

This time, the fate of the future five-star hotel that the French hotelier Laurent Taïeb intends to build at 39, boulevard de la plage, in Cap-Ferret, is not far from being definitively sealed. Fighted jointly, since November 2017, by local residents, gathered in the association “Collective of the heart of the village of Cap-Ferret” and the operators of the hotel Côté Sable, neighbor of the project, the hotel complex was mentioned this Thursday, January 13 before the Council of State.

After the administrative court of Bordeaux then the administrative court of appeal of the same jurisdiction, which both rejected in October 2018 then in December 2020 the appeals brought, the building permit, granted to the project by the mayor of Lège-Cap-Ferret on November 14, 2017, was investigated by the highest administrative court. It plans to build a 5-star hotel with 30 rooms, with a floor area of ​​1,807 square meters, with a 90-seat restaurant, as well as an underground car park. An investment of 15 million euros for the businessman.

The adversaries of the project attacked all over the place, within the framework of an appeal in cassation developing no less than twelve points. Among these, the question of the surface area of ​​the project was rejected by the public rapporteur. If he admitted that the project would occupy an area greater than that of the existing construction and that it would follow “a densification of the plot”, this would not, he considered, have a sufficient influence on the neighborhood to justify the cancellation of the building permit.

Decision within three weeks

The risk of damage to the water table has also been ruled out. While the applicants raised the incompatibility of the hotel project with the future Local Urbanism Plan (PLU), the public rapporteur stressed that it was a construction comprising only one floor, that it was also near two other hotels and that its operation was a priori not likely to cause excessive nuisance in the area.

Same observation for parking spaces, the number of which did not appear to the public rapporteur to exceed the legal limits. In the light of all of these elements, the public rapporteur therefore proposed to the judges to reject the requests. The judges of the Council of State will decide within approximately three weeks. If they followed their public rapporteur, which happens in the vast majority of cases, the promoters of 5 stars could meet their objective of starting work in the first half of 2022.

At the same time as this file, the businessman and hotelier Laurent Taïeb carried out reprisals by in turn launching proceedings against his adversary from the neighboring hotel Côté sable, first by attacking the permit for a project of extension of the hotel, but also on another project to build a house on a second plot purchased by Côté sable and which adjoins that of Laurent Taïeb’s future 5-star hotel.
