A decree published this weekend in the official journal renewed for a period of one year, from August 1, 2022 to July 31, 2023, the framework for the evolution of rents which applies in so-called “tense” agglomerations, c i.e. areas of continuous urbanization with more than 50,000 inhabitants where there is a marked imbalance between supply and demand for housing, resulting in serious difficulties of access to housing across the entire residential stock.

The agglomerations concerned are as follows: Ajaccio, Annecy, Arles, Bastia, Bayonne, Beauvais, Bordeaux, Draguignan, Fréjus, Geneva-Annemasse, Grenoble, La Rochelle, La Teste-de-Buch-Arcachon, Lille, Lyon, Marseille-Aix -in-Provence, Meaux, Menton-Monaco, Montpellier, Nantes, Nice, Paris, Saint-Nazaire, Sète, Strasbourg, Thonon-les-Bains, Toulon, Toulouse.

Not to be confused with the rent level framework (fixing a reference rent which cannot be increased by more than 20%) as in Paris Lille or Bordeaux and which is therefore superimposed on the previous mechanism according to an experiment in course until November 25, 2026.

Evolution limited to IRL

The management of the evolution of rents in tense areas consists in limiting the evolution of rents to that of the reference index of rents (IRL), in the context of a new rental or a renewal of a lease, unless the rent is manifestly undervalued. In other words, the landlord is not free to increase the rent as he pleases between two tenants.

The only case where the lessor can increase the rent more than the evolution of the IRL is when he carries out improvement works or brings them into line with the characteristics of decency. The work must have been carried out for less than 6 months for an amount at least equal to the last year of rent charged. The system applies to all housing rental contracts (bare or furnished, mobility lease) for use as a main residence or for mixed professional use and main residence.

Attention, as of August 25, it will no longer be possible to practice the slightest increase in the rent of all accommodation with a bad DPE with an F or G note, whether they are located in a tense area or not.
