US court reinstates mandatory vaccination
According to the will of US President Biden, a vaccination requirement for employees in larger companies should apply at the beginning of January. A new court decision now gives him tailwind. Since judges had previously seen it differently, the matter will now end up before the Supreme Court.
A US federal appeals court has provisionally reinstated the strict corona vaccination guidelines planned by US President Joe Biden for larger companies. Judge Jane Stranch stated that the provision to protect U.S. workers from the coronavirus could be considered permissible. At the end of November, another appellate court suspended the rules planned from January. The case is expected to go to the Supreme Court.
“The Covid-19 pandemic has wreaked havoc across America, claiming over 800,000 lives, paralyzing jobs across the country and threatening our economy,” Stranch said. Therefore, the previous order by the other court was not lawful. This had described Biden’s specifications as “dizzyingly far-reaching” and therefore suspended.
The conflicting decisions of the two courts are likely to lead to a challenge in the Supreme Court. Plaintiffs include five heavily Republican states as well as several private companies and religious groups.
Vaccination requirements common in the USA
In the United States, vaccination requirements against various diseases are not uncommon; they are usually imposed by cities or states. The present legal dispute concerns the question of whether a US president has the right under the constitution to impose a nationwide vaccination requirement.
According to the plans of the US government, employees in companies with more than 100 employees must be fully vaccinated against the coronavirus by January 4 or take a corona test once a week. Biden had announced the new vaccination requirements in September in view of a sharp increase in corona infections over the summer. According to the government, around two thirds of all employees would be affected.
