Health pass in business: several difficulties pointed out by an HRD association


COMPANY – Only mentioned as a possibility by the government a few days ago, the idea of ​​imposing the health pass at work seems to have gained ground. On LCI, the deputy vice-president of the national association of HRD, however, highlights several obstacles to the measure.

In an interview published by Brut on Sunday, Olivier Véran said the issue of the corporate health pass was now on the table. “It is for the deputies and the senators to pronounce on the question”, he indicates while affirming that “it is one more constraint that we assume”. The Ministry of Labor wishing to see this pass applied “as soon as possible”Minister Elisabeth Borne will meet the social partners on Monday to discuss the terms.

Interviewed on LCI this Sunday, the deputy vice-president of the national association of HRDs, Benoît Serre, however, underlines several difficulties in the implementation of the pass.

The question of employees who do not have a health pass

For him, this idea poses two problems. “The first is that you have people who don’t have a pass, which could disrupt businesses”, he explains. “The second concerns the legal status of employees who could not join the company because they would not have a health pass. Are they being put on leave? Are their employment contracts suspended? job ?”, he continues, implying a risk of a drop in production. “Do we put them into teleworking? But in this case the job must be compatible. This only concerns 40% of employees in France”.

Benoît Serre also mentions the possibility of teleworking, while stressing that only “40% of employees in France” have a compatible profession. The vice-president of ANDRH also points to the risk of “the windfall effect” from employees who claim not to have a pass to be able to work at home.

Pass control, a financial and human cost

Benoît Serre also highlights the cost of controlling the pass by companies. “It is up to the employer or, where applicable, the person in charge of the establishment that it is up to the control of the employee health pass. The control must be carried out every day. If the checks are not made , the employer can receive a formal notice or even a closure of his establishment for a maximum of 7 days “, tells LCI the cabinet of Elisabeth Borne.

“And ask your colleagues every day if they have their health pass, it still creates an atmosphere that is not terrible”, adds the vice-president of ANDRH.

A “progressive and targeted” measure demanded by HRDs

Rather than imposing this health pass “in all the companies of the country without exception, even those which do not have physical and direct contact with the general public”, as the cabinet of Elisabeth Borne explains, Benoît Serre would prefer that the measure be applied in a “progressive and targeted”. “When you are in a building of 200 people, it can be heard”, he believes, suggesting that the device is not necessary for small businesses.

He also suggests reserving the health pass for “brewing places” like the company restaurant. “It would allow people to work, and at the same time it would not allow them to enter places where they could increase the risk of infecting others.”

The executive would like to see this pass applied, which would not alleviate the already existing constraints, “as soon as possible”. “This will go through the law, which will be examined on January 5. With an application timetable to be discussed with the social partners.”
