The man is unemployed, has no permanent address, is an alcoholic and has a long criminal record. The 40-year-old German is accused of sexually assaulting and threatening a then 67-year-old acquaintance in Zurich two years ago. He had come to her apartment very drunk with a blood alcohol content of 2.5 and asked for something to eat.

When she said that there was hardly anything left in the fridge, according to the indictment, he held a paring knife to her chest and said: “It can hurt a lot.” Two hours later he got into bed next to her and forced her to give him oral sex. Early that morning he stole her wallet and mobile phone and used the postcard to purchase goods worth 250 francs from various places.

At the trial before the High Court on Thursday, the German denied the allegations: “I swear to God I never forced them. It was all voluntary.” He also never held a paring knife to her chest: “I swear.” There was a “good, free energy” that evening.

Regarding the 36 previous convictions since 2001, many for theft, the welfare recipient only said: “What can I say about that, I don’t see it as a problem.” He never wanted to harm anyone “mentally”. He was also once convicted of sexual harassment in Germany. He spent a long time in prison in Germany and was released from prison at the beginning of 2020 due to Corona.

In June last year, the Zurich District Court sentenced him to an unconditional prison sentence of 28 months – four months more than the public prosecutor had demanded. He is also to be expelled from the country for eight years. The court decided against therapy due to a lack of motivation on the part of the accused. His defense attorney demanded an acquittal for the sexual assault and threats and a conditional fine solely for the theft. His client should be released immediately from prison, where he has been since September 2020.

The Supreme Court did not render a verdict as of Thursday. It is a classic four-eyes crime, the woman was not sufficiently questioned by the lower court. Therefore, the court wants to summon and question them as soon as possible and only then make a judgment. When this is the case is still open.
