Lidl wins in court: discounters are allowed to offer cheap Thermomix alternatives again

Thermomix manufacturer Vorwerk has filed a lawsuit against one of Lidl’s biggest hits. Now the discounter could defend itself against it. For customers, this means that Monsieur Cuisine can be resold.

Lidl was able to win a dispute with Vorwerk. As reported by “Spiegel”, among other things, Vorwerk’s lawsuit against the discounter was dismissed in court. Originally, the company had sued Lidl because of the Monsieur Cuisines. Similar to the Vorwerk product Thermomix, this is a food processor with various functions.

According to Vorwerk, Lidl stole intellectual property with the Monsieur Cuisine. The Spanish Court of Appeal has now found that the technical specifications of the two devices are so different that no theft can be determined. In addition, the patent on the Thermomix would not involve any “inventive step” and therefore would not justify any protection of property.

Originally, the lawsuit was approved by a lower court. Lidl should therefore have taken Monsieur Cuisine off the market and Vorwerk would have had to pay damages and the legal costs. That won’t happen anymore. Lidl customers can therefore continue to look forward to the food processor.

Especially since the Monsieur Cuisine is now regularly available again. When the cheap alternative to the Thermomix started, the devices were sold out very quickly.
