For one of the rare texts devoted to local authorities in this term of office, the “3DS” law – for differentiation, decentralization, deconcentration and simplification – is defined first and foremost by what it does not contain. Neither a “Great evening of decentralization” neither one “Territorial big bang”, this bill which continues to walk under the media radars, despite its some 3,400 amendments under consideration in the National Assembly and its 250 articles expected at the end of the parliamentary shuttle, is nonetheless politically loaded with meaning.

Seven months after its presentation to the Council of Ministers and four and a half months after its adoption at first reading in the Senate, the National Assembly has seized since Monday, December 6 of this last river text of the five-year term. “Simplify public action, remove unnecessary brakes and facilitate the daily life of mayors and elected officials”, this is the promise made in these new provisions, according to the Minister for Territorial Cohesion, Jacqueline Gourault, as a preamble to the debates at the Palais-Bourbon.

Water management by inter-municipal authorities, redefinition of the status of the Aix-Marseille-Provence metropolis, extension of the SRU law on social housing, governance of regional health agencies, development and management of non-concessionary national roads, law funeral, installation of wind turbines and radars … In the Assembly, the oppositions did not hesitate to denounce once again a bill “Broom wagon, tote, very technical” which would only correspond to the real expectations of local authorities in terms of decentralization and freedoms granted to local elected representatives.

“You reoffend. Once again, you are making a rough text, difficult to read, made up of 200 articles, some of which modify laws that are less than four months old, such as the climate and resilience law ”, rebelled the president of the group La France insoumise, Mathilde Panot, defending yet another motion of prior rejection.

“It is a succession of measures which are not of revolutionary magnitude, but it is a question of resolving difficulties which have been there for a long time and which are important for elected officials and for ourselves”, moderates the co-rapporteur of the text at the National Assembly, Elodie Jacquier-Laforge (MoDem, Isère). First a response to the crisis of “yellow vests” after the great national debate in spring 2019 during which Emmanuel Macron had announced with great fanfare his desire to establish “A new democracy, a new decentralized organization and a new administration”, the “3DS” bill is above all intended to satisfy local elected officials, after two years of consultation led in particular by Mr.me Gourault.
