The Higher Administrative Court (OVG) Münster has confirmed (file number: 13 B 1911/21, 13 B 1912/21 and 13 B 1913/21) that the porn portals Pornhub, Youporn and Mydirtyhobby (these are not named in the OVG judgment mentioned, but it is clear that these three portals are involved) must not be accessible in Germany as long as they do not introduce a youth protection system that guarantees that only adults have access to their content.
With its current decision, the OVG has rejected the complaint of the two operators of the porn portals mentioned against the previous decision of the Düsseldorf Administrative Court (VG Düsseldorf 27 L 1414/20, 27 L 1415/20, 27 L 1416/20). Because the Düsseldorf Administrative Court had previously confirmed the corresponding bans of the State Media Authority of North Rhine-Westphalia. The decisions of the Higher Administrative Court are final.
Landesanstalt für Medien NRW bans the content of the three porn portals
At the time, the State Media Authority of North Rhine-Westphalia had ordered Pornhub, YouPorn and Mydirtyhobby to make their pornographic content inaccessible to young people. This is possible, for example, by requiring every online visitor to present proof of age. As long as this is not the case, Pornhub, YouPorn and Mydirtyhobby are not allowed to offer their content in Germany. But the operators of the portals mentioned refuse to introduce appropriate youth protection measures.
Düsseldorf Administrative Court agrees with the North Rhine-Westphalia Media Authority
The two providers of pornographic websites, which have their headquarters in Cyprus, had appealed to the Düsseldorf Administrative Court against the ban imposed by the North Rhine-Westphalia Media Authority. But this agreed with the state media authority. The operators of the porn portals have now lodged an urgent appeal with the Münster Higher Administrative Court against this decision by the Düsseldorf judges.
But the OVG Münster has now expressly confirmed that porn portals that are based in other European countries can also be regulated by German youth protection officers.
