Pension reform, law strengthening the protection of families of seriously ill children….several texts have granted new rights or improved social protection for parents.

When a child arrives, what leave should I receive and how much is it paid?

Parents benefit from maternity, paternity or adoption leave. As such, they receive daily allowances paid by Social Security (IJSS) subject to proof of a minimum duration of affiliation with health insurance. This has been shortened for births since August 20, 2023. 6 months of affiliation are enough to be compensated (instead of 10 months).
Please note: this measure concerns employees, intermittent workers in the entertainment industry, farmers and the self-employed. (Decree of August 19, 2023).

Pension reform, what changes for parents

The pension reform gradually raised the legal retirement age in order to reach 64 years for people born in 1968. Mothers are the most penalized because, often, they will reach the age of the full rate (allowing them to receive a full pension) before their 64th birthday thanks to the quarterly increases allocated for their children (8 quarters per child for private sector employees and 4 quarters for civil servants), but they won’t be able to leave before then. In return, some compensation was granted to them.

Long maternity leave better taken into account

Every quarter maternity leave are now taken into account when calculating retirement, which will no longer cause a career gap for mothers of large families and will improve the amount of their pension.

Explanations. Since 2012, daily allowances received during maternity leave have, like salaries, been included in the average annual income, which serves as the basis for calculating the amount of your pension. Until now, maternity leave was only counted within the limit of one quarter per child. However, for multiple pregnancies or births from the 3rd child, the leave lasts at least 6 months.

A parental premium for those leaving at 64

Mothers like fathers who, due to the reform, will not be able to leave before age 64, will be able to enjoy a bonus of up to 5%applied to the basic pension amount.

On the double condition:

– Proof of at least one quarter acquired thanks to their children (for maternity leave, adoption, education, disabled child, or parental leave)

– Meet the duration of insurance required for the full rate at age 63.

Several measures resulting from the law of July 19, 2023 aim to better protect the parents of a seriously ill or disabled child with regard to their employment, their housing and the granting of financial aid.

For the job

– Easy access to teleworking. The employer’s refusal must be justified.

– Protection against dismissal during the parental leave (unless the employee commits serious misconduct).

– Specific absence authorizations: thus paid leave on the occasion of the death of a child is increased to 14 days (instead of 7 days) if he is under 25 years old, 12 days if he is over 25 years old.

– The specific leave for the announcement of the occurrence of illness or disability (cancer, chronic pathology, etc.) increases to 5 days (instead of 2). This specific leave concerns the announcement of a disability, cancer or chronic pathology appearing on the list of long-term illnesses (ALD) (cystic fibrosis, myopathy, epilepsy, serious progressive scoliosis, etc.).

For housing

If they are tenants, the parents of a disabled or seriously ill child see each other protect against termination of their lease. In fact, the owner will no longer be able to give them notice when it is renewed. Benefit from this protection, parents who receive the daily parental presence allowance and who have low resources (€37,611 for 2 people in IDF, €29,217 in the region).

On the financial side, the payment of the daily parental presence allowance (AJPP) by the CAF is accelerated.
€62.44 this is the daily amount of the parental presence allowance up to 22 days per month. This financial assistance is granted, under conditions, if you need to temporarily cease your activity to care for your child under 20 years of age suffering from an illness or disability or an accident of particular seriousness. The right is open for 3 years, renewable.

In 2025, a new family leave

During November 2023, the Minister of Solidarity announced the creation of a new “family leave” from which young parents will each be able to benefit following their maternity or paternity leave. It will not replace the current parental leave – parents will have the choice -, but should be better paid (€429 for current parental leave).
