The new information obligations for private rental advertisements, News/Actu Immobilier



After the professionals since April 1, it is the turn of individuals to have to provide better information to future tenants in their rental announcements, regardless of the medium used.

From this Friday, July 1, announcements relating to the rental of accommodation must thus mention a whole series of information relating to the property concerned, the pricing conditions of this rental as well as the possible application rent control in the territories concerned by this system.

In order to ensure a level of consumer information equivalent to that already provided for advertisements published by professionals, an order lists the information to be provided:

  • The municipality and, if applicable, the district in which the property is located.
  • The surface of the rented property expressed in m² of living space. The surface area of ​​unfinished attics, cellars, basements, sheds, garages, terraces, loggias, balconies, dryers outside the accommodation, verandas, common areas and other outbuildings of the accommodation, nor of the parts premises with a height of less than 1.80 metres.
  • The amount of the monthly rent, increased if necessary by the additional rent and charges (recoverable by the owner), followed by the mention ” per month “ and, if applicable, the words “charges included”. These can respectively be abbreviated as ” /month “ and ” CC “.
  • The amount of recoverable charges entered in the rental contract and in any case the terms of payment of these charges.
  • The amount of any security deposit required.
  • The furnished nature of the rental must appear if this is the case.
  • The amount, all taxes included, of any fees charged to the tenant due for carrying out the inventory.

Rent control

For properties located in territories where rent control applies (such as in Paris, Lille, Lyon, Villeurbanne, Bordeaux or Montpellier), the statement “Area subject to rent control” must appear and be followed by the amount of the increased reference rent preceded by the words “Increased reference rent (basic rent not to be exceeded)”. The amount of the basic rent must also be mentioned, as well as the possible amount of the additional rent required if the accommodation has special characteristics of location or comfort compared to neighboring accommodation.

The purpose of these obligations is to provide future tenants with better information and to limit advertisements that do not comply with the rent ceilings.
