Trial in Feldkirch – “Milieu dispute with bite” at the regional court

A dog vehemently defended his homeless owner and bit his opponent several times on the leg. The defendant appeared remorseful in court and the judge was merciful.

The defendant greets the judge and public prosecutor with a casual “Hello everyone.” At least the walk from the cell to the hearing room is a small change from everyday prison life. Sentenced to nine months in prison in mid-July for dangerous threats or death threats, the 31-year-old Oberlander now has to answer in court for further death threats and negligent bodily harm. It is about a social dispute between the drug-addicted homeless man and three other people in Feldkirchen city center . “The defendant had threatened to slash an opponent and cut the child out of his pregnant girlfriend’s stomach. He is said to have waved a broken glass bottle around in front of them. Then the accused’s dog is said to have attacked the third member of the group and bitten him on the leg several times,” said public prosecutor Richard Gschwenter. What the delinquent also openly admits. However, he denies having set the promenade crowd on his opponent. “That was his protective instinct. I had the dog on a leash, albeit on a power cable.” The fact that the four-legged friend has now buried his teeth in other people’s calves for the second time doesn’t make things any better. Because the defendant shows sincere remorse and has already written an apology from prison sent to those affected, judge Christoph Stadler shows leniency and sentences the 31-year-old to a conditional additional sentence of three months in prison. The defendant accepts the verdict. Prosecutor Gschwenter doesn’t make any explanation, but says: “I want to report positively to the senior public prosecutor.”
