4,500 euros for the sale and maintenance of a carpet: a trader convicted of abuse of weakness in Isère


It is a dark case of abuse of weakness which was judged at the beginning of the week before the Criminal Court of Grenoble, tells us The Dauphiné freed. The facts date back to the end of 2019. At that time, the son of an octogenarian was surprised at a rather substantial check: 4,650 euros for a purchase of rugs. As his mother has Alzheimer’s disease and placed under curatorship, he opposes the check because he has never seen a trace of the carpet at his home. For his part, the trader has another speech: according to him, as the check was refused, he therefore came to look for the carpet.

For this sum, for which he does not initially give an invoice in 2019, he explains that he invoiced the carpet for 3,350 euros and the cleaning of another for 1,300 euros. The Dauphine recalls that at the material time, placed in police custody, the gendarmes asked him with a touch of irony if he did not find his services a little too expensive. He then blurted out: “It’s called trade”.

Conditional prison

Two years later, in court in Grenoble, the 41-year-old man came with an invoice. Accused of abuse of weakness, he denied outright and specified that his client – whom he had also known for a long time – “moved normally, walked normally and came to the market”. Not enough for the court which told him that it could not “ignore the state of weakness” of the octogenarian. Eventually found guilty, he was sentenced to a warning and six months suspended prison sentence. The octogenarian will not have paid this time the 4,650 euros, but in the past, she had already paid to this man for 7,000 euros between 2015 and 2016.

As a reminder, the abuse of weakness, which is a crime, consists in taking advantage of a person’s weakness – whether physical or moral – or even his ignorance, to try to extort something from him or to do something to him. sign a contract that is unsuitable for their real needs.
