Audiovisual producers who work for Netflix or Disney Channel will have access to CNC aid

From 1er January 2023, French and European producers established in France will be able to apply for financial aid from the National Center for Cinema and the Moving Image (CNC) for the preparation and production of their audiovisual projects (i.e. excluding films ) pre-financed by a platform or foreign channels such as Netflix, Disney Channel, Amazon Prime Video or Apple TV + for example, indicates the Official newspaper of December 15.

Adopted by the CNC’s board of directors on December 8, this reform of support constitutes, according to the management of the CNC “a new stage in the integration of these foreign players into our production system”.

Since 1er July 2021, France was the first European country to oblige foreign platforms targeting French territory to finance film and audiovisual production. These obligations had been imposed within the framework of the decree which sets the rules applicable to on-demand audiovisual media services (SMAD), after the transposition in France of the European directive on audiovisual media services (SMAD). This text made it possible to consolidate the financing of French and European creation, while requiring these new players to work with independent producers.

Team parity

In the text published in the Official Journal on December 15, certain adjustments have been made. To avoid in particular that the continuous exhibition of a work in many territories “exhausts its value and deprives its producer of opportunity” to exploit it in the long term, the duration of the rights acquired by the platforms has been capped at seventy-two months, thirty-six of which are exclusive.

From 1er January 2023, the CNC will also ask audiovisual producers to scrupulously ensure the parity of film crews. A specific form relating to the identity and sex of all employees will be required in order to be able to receive aid. This concerns all professions, from the producer, to the author of the script, to the director, to the director of photography, to the cinematographer, to the costume designer, to the production designer, to the editor…

In the field of cinema, no novelties in the aid specified in the OJ. Film producers are already benefiting from additional funding windows thanks to the platforms since July 2021. The first applications for films that include platforms in their co-financing plan were presented to the CNC in 2022. These films should be released in theaters from 2023.
