Court in Rottweil gives little hope to Biontech plaintiffs

In Rottweil and Bamberg, two processes are starting about possible damage caused by corona vaccinations. The pharmaceutical companies Astrazeneca and Biontech are in the dock. The plaintiffs hope for high compensation.
A civil lawsuit against the vaccine manufacturer Biontech because of possible health damage from a corona vaccination has begun before the Rottweil district court. A 58-year-old accuses the Mainz-based company of being almost completely blind in the right eye as a result of the vaccination. He demands 150,000 euros in damages. He also wants to oblige Biontech to compensate for possible material damage.
According to the presiding judge, however, it will probably be difficult for the plaintiff to enforce his claims. For example, there is no right to compensation if the risk-benefit ratio of a drug is positive. The plaintiff argues that the current state of knowledge must be taken into account in the risk-benefit ratio. In addition, there was only provisional approval for the vaccine when his client was vaccinated in 2021, the 58-year-old’s lawyer said. After that, the vaccine was changed. The court could announce a decision in the case at the end of September.
Appeal process against Astrazeneca in Bamberg
Parallel to the case in Rottweil, Baden-Württemberg, civil proceedings were also started before the Higher Regional Court in Bamberg, Bavaria, about suspected corona vaccination damage. A woman is already suing the vaccine manufacturer Astrazeneca in the second instance in appeal proceedings after the Hof district court rejected her application for compensation for pain and suffering of at least 250,000 euros and other benefits in January as unfounded.
The plaintiff claims permanent intestinal damage after a thrombosis. Among other things, she was in the intensive care unit, and parts of her small intestine had to be surgically removed. According to her lawsuit, she has been severely impaired both physically and mentally since then. However, the Hof District Court rejected this as unfounded because no product or information errors had been presented. The woman appealed against this.
According to a court spokesman, after discussing the factual and legal situation in the matter, the responsible Senate in Bamberg set an announcement date for August 14th. Accordingly, a decision will not necessarily be announced. Among other things, an advisory decision or a decision as to whether experts are to be called in to the procedure is also conceivable.
200 civil lawsuits for alleged vaccine damage
The processes in Rottweil and Bamberg are among the first in a whole series of proceedings against various vaccine manufacturers, which are currently being launched nationwide before German civil courts, because of alleged vaccine damage. The plaintiffs are claiming damages and pain and suffering for damage to health allegedly resulting from the vaccinations. The manufacturers reject their claims and deny that they are responsible in these cases or that the damage to health is causally related to the vaccinations.
According to media reports, a total of more than 200 civil lawsuits due to alleged vaccine damage are now pending in court or are being prepared. Regardless of this, almost 9,000 people nationwide applied to the authorities for recognition of vaccination damage, which is a separate procedure for damage settlement. Less than 400 of these have been recognized so far.
According to the authorities, around 64.9 million people in Germany were vaccinated against corona in the course of the corona pandemic by April 2023. A total of around 192.2 million vaccine doses of various types were administered.
