Notaries, bailiffs… Here are the regulated prices for 2024

A series of decrees published on February 29, 2024 in the Official Journal sets the average result rate objectives and the regulated rates, for the period from March 1, 2024 to February 28, 2026, for notaries, judicial administrators and judicial agents as well as bailiffs and judicial auctioneers.

These are four judgments, published on February 29, 2024 at Official newspaper and entered into force on March 1, 2024, which set the average result rate objective, (i.e. the rate which serves as a calculation basis to determine the reasonable remuneration which notaries can claim based on an act, Editor’s note) and the reference period for the regulated rates of notaries, judicial administrators and judicial agents, as well as bailiffs and judicial auctioneers, and commercial court clerks.

Nothing changes for notaries

Concerning notaries first of all, the figures remain the same. The average profit rate objective is maintained at 27.6%, over the period from March 1, 2024 to February 28, 2026. However, the stop indicates that these fees are increased by 25% in Wallis and Futuna, by 23% in the department of Guadeloupe, by 24% in the department of Martinique, by 20% in the department of Guyana and by 36% in the departments of La Réunion and Mayotte.

In a press release press release dated February 29, the higher council of notaries (CSN) welcomes this interministerial decision. For bailiffs, the average result rate objective is set at 29.9% and 30.6% for judicial auctioneers, for the same period from March 1, 2024 to February 28, 2026. The judgment confirms also the increase in certain fees. Thus, the costs for a summons (unilateral act by which the plaintiff informs the defendant that he is taking legal action against him) increase from 18.09 euros to 18.28 euros. The service of the request and order for payment, the first step in recovering a debt through legal means, increases from 25.53 euros to 25.79 euros.

The average result rate objective is fixed, for judicial administrators, 28%, and 26.1% for judicial representatives. Finally, the latter is fixed 32% for commercial court clerks.

Exempting rules until May

By way of exemption, whether for bailiffs, judicial auctioneers, or commercial court clerks, the old rates apply if a service is provided before May 1, 2024, or if its completion required the payment of a deposit or a provision before March 1st. Concerning administrators and legal representatives, same principle for procedures opened before March 1, 2024.
