Rental duration, tax relief, DPE… What is contained in the Airbnb law which arrives in the Senate this Tuesday

Starting this Tuesday, senators are examining a law imposing new restrictions on owners who would like to rent their house or apartment on platforms such as Airbnb. If the text is adopted, owners will have five years to comply with it.

Intended to combat the housing crisis, the Airbnb law arrives in the Senate this Tuesday. The text introduces new restrictions for owners, notably concerning the rental period, the tax reduction and even the energy diagnosis. Clearly, many changes await owners who would like to rent their apartment or house occasionally.

“Respond to the distress of these mayors”

Mayors could therefore decide to reduce the maximum annual duration of a short-term rental. According to Sylviane Noël, senator and rapporteur of the text, it would be a question of limiting tourist pressure in certain municipalities. “I am thinking in particular of the town of Annecy which is very concerned by this problem. In certain neighborhoods, where people are starting to rent their main residence, because it is very profitable and very attractive, this inevitably causes some nuisance. “It’s a way of responding to the distress of these mayors.”

The text then hits the owners in the wallet. The tax reduction would be halved, from 70 to 30%. Finally, the bill plans to prohibit tourist rental for apartments with a DPE lower than D. If the text is adopted, owners will have five years to adapt to this new restriction.
