his family gets suspended from a pot

A fund created to provide financial assistance to Cédric Jubillar, husband of the missing Tarn, has been removed. This raises the question of compensation for non-pecuniary damage in this case, and more broadly, during "various events".

Delphine Jubillar is a 33-year-old nurse, mother of two small children, who disappeared in the Tarn during the night of December 15 to 16, 2020. Since this mysterious disappearance, reported by her husband Cédric Jubillar, no clue has been discovered . Searches in the house, around the grounds and hearing the children give no answer. This is the criminal track that prevails today as an investigation is underway to "arbitrary kidnapping, detention or forcible confinement for more than seven days". Since then, relations seem strained between the relatives of the two spouses, who were in the process of divorce. Latest fact: the family of Cédric Jubillar had opened an online kitty to financially help the husband of the missing. Indeed, the couple lived mainly on the salary of Delphine Jubillar, Cédric having no fixed income as a craftsman. This pot, launched on the Cotizup site, would have raised a few hundred euros, before its removal at the initiative of relatives of the disappeared. The Cotizup site did not provide any explanation for this closure, which was deemed arbitrary by those close to Cédric.

The thorny issue of money in this type of business

The Jubillar case is often compared to the Daval case. While the two cannot be compared for the moment, the first had raised the delicate question of money in disappearance and murder cases. Indeed, the parents of Alexia Fouillot, the victim of Jonhathann Daval, are currently claiming € 150,000 each from the culprit. This is the usual procedure in these types of cases: relatives of victims of disappearance and / or murder ask for money for so-called affection damage. The mediatization of the cases being able to increase the sum, in view of the moral pressures and the stress which can be undergone.

However, no race for money possible on the side of families: the amounts are fixed by a relatively precise scale established by case law. For example, for the death of a child, it rarely exceeds 40,000 euros. Rather, it is calculated according to the family tie and proximity to the victims. Finally, there are no criteria linked to the disappearance of resources following the disappearance of the only fixed household salary.
So much information unknown to the general public, which sometimes reacts strongly to questions of money on the sidelines of "miscellaneous", as was the case in December 2020, when the amount requested by Alexia's parents was announced. In view of the pain of families during a feminicide or a disappearance, this large sum suddenly seems very low.
